On 31 March 2026, the Minister of Forestry, Fisheries and the Environment officially promulgated the new National Dust Control Regulations. These updated regulations replace the 2013 framework and introduce more stringent requirements for industrial activities that generate dust.

The updated framework focuses on standardized testing and proactive management:
- Standardized Test Method: The prescribed method for measuring dustfall is now strictly SANS 1137 (or an equivalent international standard).
- Residential vs. Non-Residential Limits: Legally binding dustfall rates remain focused on protecting human health and the environment:
- Residential Areas: 600 mg/m²/day.
- Non-Residential Areas: 1200 mg/m²/day.
- Stricter Monitoring: Dust monitoring programs must now include both soluble and insoluble fractions and be conducted by SANAS ISO 17025-accredited laboratories to ensure the data is world-class and legally defensible.
Mandatory Transitional Steps
If you have an existing operation, you are likely affected by the Transitional Provisions:
- Existing Plans: All existing approved Dust Management Plans must be reviewed and resubmitted within 60 days of the regulations coming into effect (by 30 May 2026).
- Continued Validity: While your new plan is under review, your existing plan remains valid with full legal force.

- First Offence: A fine not exceeding R5 million or imprisonment for up to five years.
